Carman is a senior litigation lawyer with extensive experience in all aspects of employment law, labour relations law and civil litigation. Throughout his career he has maintained a special focus on advising employers on resolving workplace disputes. Carman works closely with senior management and human resources management professionals to ensure employers comply with legislation and to assist them in the prevention and resolution of employment disputes. Carman also advises employees on contractual matters including severance and continuing post-employment obligations.

Over his career Carman has appeared in a wide variety of matters before the Supreme Court of BC, the Court of Appeal of BC, the BC Human Rights Tribunal, the Employment Standards Tribunal, the BC Labour Relations Board, the Canadian Industrial Relations Board, and the Workers' Compensation Appeal Tribunal. Carman has also represented employers in labour arbitration proceedings and in collective bargaining.

Carman is a frequent lecturer and routinely presents on workplace law developments including the duty to accommodate, social media issues, and privacy concerns arising from the growth in workplace technology. He also is a Co-Author of the Employment Litigation Manual published by Butterworths/LexisNexis since 2007.

Defended simultaneous proceedings brought by dismissed employees before the BC Human Rights Tribunal and the Supreme Court of BC.

Counsel for Echo Bay Mines Ltd. in the Supreme Court of BC, the BC Court of Appeal and in successfully defending the application for leave to appeal to the Supreme Court of Canada.

Successfully represented the Canadian National Railway Company in an application to the Court for an Order dismissing the claim by the Executrix of the Estate of a deceased employee of CN on the basis that the Court had no jurisdiction. Both the Supreme Court of British Columbia and the Court of Appeal of British Columbia held that the matter arose from the collective agreement negotiated by CN with the trade union that represented the deceased employee.

Successfully represented the Insurance Corporation of British Columbia in defending a claim for damages for wrongful dismissal and defamation including claims for punitive damages and aggravated damages made by a former manager.

Obtained a dismissal of a complaint to the BC Human Rights Tribunal by a former employee of Martin - Brower Canada involving allegations of discrimination on the basis of disability where the employee was dismissed for failing to comply with a drug / alcohol rehabilitation program.

Represented an employer in an 8 day labour arbitration where the arbitrator upheld the dismissal of a bargaining unit employee for harassment and bullying of a co-worker - Madill Equipment Canada v. United Steelworkers Union, Local 1-80, CLC (Brown Dismissal Grievance), [2008] BCA.A.A. No. 86

Raval v. APT Auto Parts Ltd., 2008 BCHRT 170( Contracting Out Grievance, [2006] BCA.A.A No.86, 85 C.L.A .S. 198) Lilydale Cooperative Ltd. v United Food and Commercial Workers Union, Local 1518.

(Rollerman Duty to Accommodate Grievance), [2004] BCA.A.A No.101) Lilydale Cooperative Ltd. v United Food and Commercial Workers Union, Local 1518.

Appeared at the BC Labour Relations Board on behalf of an employer in a hearing to determine a jurisdiction dispute between an International Union and a local Union and the enforceability of a collective agreement.

Advised Employer in a wrongful dismissal proceeding on the appropriateness of trial by Judge and Jury and process under the Rules of Court for striking a Jury Notice.

Provided submissions to the Workers' Compensation Appeal Tribunal regarding appointment of medical expert.

Advised on drug testing policy in connection with safety sensitive work.

Advised and drafted a Last Chance Agreement with a union employee dealing with alcohol/drug addiction

Advised on human rights issues including employer duty to accommodate arising from employee drug/alcohol addiction and testing of employee

Advised on workplace fatality arising from suspected drug use and workers compensation proceedings.
